12. Dispute Resolution: Mandatory Binding Arbitration & Class Action Waiver

Agreement to Arbitrate: You and AESTHETIC agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site (collectively, "Disputes") will be resolved by binding arbitration, rather than in court.

Arbitration Procedure: The arbitration will be administered by a neutral arbitrator in Casper, Wyoming, in accordance with the laws of the State of Wyoming.

Class Action Waiver: YOU AND AESTHETIC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Jury Trial Waiver: You and AESTHETIC hereby waive any constitutional and statutory rights to sue in court and have a trial in front of a judge or a jury.

30-Day Opt-Out Right: You have the right to opt out of the arbitration provisions of this Section by sending written notice of your decision to opt out to support@myaesthetic.co within 30 days after first becoming subject to this Arbitration Agreement.

Time Limitation on Claims: You agree that any claim you may have arising out of or related to your relationship with AESTHETIC must be filed within one (1) year after such claim arose; otherwise, your claim is permanently barred.

13. Severability

If any provision of these Terms is found unlawful or unenforceable, that provision shall be severed, and all other provisions shall remain in full force and effect.

14. Termination

These Terms are effective until terminated by either party. We may terminate this agreement at any time without notice if you violate any provision. You remain liable for all amounts due through the termination date.

15. Entire Agreement

These Terms constitute the entire agreement between you and us and supersede all prior agreements, whether oral or written.

16. Governing Law

These Terms and any dispute of any sort that might arise between you and AESTHETIC shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles.

17. Changes to Terms

We reserve the right to update these Terms at any time. The most up-to-date version will always be displayed on our Site. Your continued use of the Site following any changes constitutes acceptance of the updated Terms.
